Attorney for Cannabis-Related Drug Crimes in DuPage County

As of January 1, 2020, the consumption and sale of recreational marijuana are legal in Illinois. However, this does not mean that a person cannot face criminal charges related to marijuana or cannabis-containing products.

My name is Stephen A. Brundage, and I am a criminal defense attorney serving DuPage County, Illinois, and the surrounding areas. If you or a loved one are facing charges related to cannabis, I can help you build a solid defense against the charges. I provide aggressive representation during criminal proceedings and knowledgeable legal guidance throughout my clients' cases. As a former police officer, I know the procedures law enforcement officials must follow when conducting a search or making a drug-related arrest. This enables me to spot errors that may invalidate the evidence against you or even lead to your charges being dismissed.

Illinois Defense Lawyer for Marijuana Charges

The laws surrounding the consumption, cultivation, and sale of cannabis are constantly changing. While it is now legal to buy and consume marijuana flower or THC-containing products in Illinois, there are still several ways that you can be arrested and charged with a marijuana-related crime. I am qualified to represent individuals accused of a range of marijuana-related charges, including:

  • Marijuana possession
  • Underage possession of marijuana
  • Possession with intent to distribute
  • Sale or delivery of marijuana

Attorney for Marijuana Possession in Kane County

To purchase marijuana legally, you must be at least 21 years old. Only licensed dispensaries are permitted to sell marijuana. Illinois residents may possess up to 30 grams of cannabis flower and 500 mg of THC products, including marijuana edibles. If you are caught with more than 30 grams, you risk arrest and criminal charges. Possession of 30-100 grams of marijuana flower is a misdemeanor offense. While possession of greater than 100 grams of marijuana is a felony offense. The current penalties for marijuana possession include:

  • 30 to 100 grams is a Class A misdemeanor offense punishable by up to one year in jail and a fine of up to $2,500
  • 100 to 500 grams is a Class 4 felony offense punishable by 1- 3 years in prison
  • 500 to 2,000 grams is a Class 3 felony offense punishable by 2-5 years in prison
  • 2,000 to 5,000 grams is a Class 2 felony offense punishable by up to 7 years in prison
  • Possession of greater than 5,000 grams is a Class 1 felony offense punishable by up to 15 years in prison

In addition to jail time, the penalties for marijuana possession greater than 30 grams include steep fees. Although the use of marijuana for recreational purposes is legal in Illinois, you can still face criminal consequences for possessing cannabis. This is why it is crucial to work with an experienced criminal defense lawyer if you have been arrested and charged with a marijuana offense.
